Acceptable use policy for Asergo

This Acceptable Use Policy (“AUP”) outlines prohibited activities on Asergo’s services to protect Asergo, its infrastructure, and its customers. For questions, contact [email protected].


1. PROHIBITED ACTIVITIES

Customers shall not use Asergo’s services (dedicated servers, Kubernetes clusters, S3 Storage, or network) to engage in, facilitate, or promote:

  • Illegal or Unauthorized Activities: Any conduct that violates applicable laws, regulations, or third-party rights (including intellectual property, privacy, or confidentiality).
  • Network Abuse: Unauthorized access, monitoring, or interference with any system, network, or data; or the introduction of malicious code (e.g., viruses, worms, Trojans).
  • Security Violations: Actions that compromise the security or integrity of Asergo’s infrastructure or other customers’ systems, including vulnerability testing without prior written consent.
  • Fraud or Deception: Misleading or deceptive practices, such as phishing, spoofing, or forging packet headers.
  • High-Risk Use: Any use where failure of Asergo’s services could result in death, serious injury, or significant environmental damage (e.g., life-support systems, mass transportation, or hazardous materials).
  • Resource Abuse: Consuming disproportionate resources (e.g., bandwidth, storage, or compute) that disrupts service for others.
  • Offensive or Harmful Content: Hosting, transmitting, or linking to content that is illegal, obscene, defamatory, or promotes violence, hate speech, or harassment.

2. EMAIL AND COMMUNICATION REQUIREMENTS

For bulk or commercial email sent via Asergo’s services:

  • Maintain a valid privacy policy and a public abuse/complaint contact.
  • Obtain and honor affirmative consent from recipients; provide clear opt-out mechanisms.
  • Include accurate sender information and honor unsubscribe requests within 72 hours.

3. LICENSE AND SUPPORT COMPLIANCE

  • Customers must comply with all license terms for any software (open-source or third-party) used on Asergo’s infrastructure.
  • Customers are responsible for maintaining valid licenses and vendor support for non-Asergo software.
  • Asergo may request proof of compliance; failure to provide it may result in service suspension or additional fees.

4. EXPORT AND SANCTIONS COMPLIANCE

  • Customers shall not use Asergo’s services in violation of EU or international export controls, sanctions, or laws.
  • Prohibited uses include activities related to terrorism, human trafficking, illegal gambling, or weapons proliferation.

5. COOPERATION WITH INVESTIGATIONS

  • Asergo may disclose customer data or traffic to authorities if legally required, with reasonable notice where possible.
  • Asergo may report suspected illegal activity to authorities without notice.
  • Customers must cooperate with Asergo’s investigations into suspected AUP violations.

6. DOMAIN, IP, AND DNS REQUIREMENTS

  • Customers must maintain accurate domain registration information.
  • Only use IP addresses assigned by Asergo; unauthorized use of IPs is prohibited.
  • Asergo may modify or remove DNS records upon request from authorized contacts.

7. AUP CHANGES AND ENFORCEMENT

  • Asergo may update this AUP by posting revisions at asergo.com/legal/acceptable-use-policy. Material changes will be communicated 30 days in advance.
  • Customers may terminate services if changes are unacceptable, with a 90-day grace period under the prior AUP.
  • Violations may result in content removal, service suspension, or termination, without credit for downtime.

8. CUSTOMER RESPONSIBILITIES

  • Customers are responsible for all activity originating from their accounts, even if unauthorized.
  • Customers must use reasonable security measures to prevent AUP breaches.
